Switzerland Court dismissed Crocs’ request for a preliminary injunction against Holeys


On November 12, 2008, the Switzerland Court dismissed Crocs’ request for a preliminary injunction against Holeys and their Swiss distributor, and ordered Crocs to pay Holeys' costs.  The Court determined that Crocs’ Beach model is neither original nor that it has acquired secondary meaning in Switzerland.

 

Holeys has now won all 7 court cases worldwide related to Crocs’ contention that Holeys products infringe their intellectual property.  These legal challenges have been won in the U.S.A, South Africa, EU (OHIM), France and Switzerland.  As they have done in the other cases, Holeys anticipates that Crocs will appeal the Swiss decision.

 

Holeys position has always been that their products do not infringe intellectual property held by any other company and the courts in many jurisdictions continue to support Holeys' position.
